Code Enforcement Complaints
According to New York states page located HERE, there are numerous things that the Building Standards and Codes WON’T act on, from their webpage the list is as follows:
“In general, the BSC would have no authority to investigate allegations of activities such as:
- selective enforcement by a local code enforcement official;
- harassment by a local code enforcement official;
- inappropriate or offensive conduct by a local code enforcement official; and
- suspected illegal activity related to official duties by a local code enforcement official (e.g., accepting bribes, trespassing, slander and/or libel).”
It’s more than a little frustrating to have absolutely NO recourse when you have Code Enforcement illegally coming into your home with no search warrant and then just repeatedly parking in front of your home writing violations while 10 other people on the street with the same issue get bypassed. I understand that probably EVERYONE thinks code enforcement is singling them out and my thoughts are that sometimes they actually ARE. Get a judge who tells the city that entering someones home with no search warrant is “perfectly fine” and things just get worse.
What do you do when you believe you ARE being singled out?! Right now, I am in the process of writing a letter to our new judge about the old judge who said that it was fine to not have a search warrant. Then, I am sending the same letter to our district judge, and any other judge or official who seems like they could have a say in this. I’m also collecting the names of others who either already have complained, or who want to complain and keeping a running total. Having more than 1 person say that code enforcement is selectively enforcing the laws while ignoring other blatant issues is pretty sad.
I will also put it up here and give a play by play of what happens. I am hoping I can find more officials to send it to because this has gotten beyond ridiculous.
Thinking about moving to the city of Batavia? I’d definitely think twice. Since this all began we’ve heard time and time again how moving away from Batavia is top on their To-Do list. I know people who have lived here their whole lives who are exiting as fast as they possibly can.
