Violation Notices
We’ve gotten a million of them. Beyond annoying when your neighbor is breaking the same code not 5 feet from your door yet they don’t get a violation. I did find out though that according to the State of New York Department of State Division of Code Enforcement & Administration list of laws under PART 1202 – UNIFORM CODE: ADMINISTRATION AND ENFORCEMENT IN CERTAIN LOCAL GOVERNMENTS, violation notices are supposed to be sent via registered or certified mail. Under section 1202.5, Orders and Violations, it states:
“(b) Orders to correct violations of the Uniform Code or this Part shall be served in person upon a responsible party or his authorized agent or by registered mail sent to the address of such responsible party. ”
Not ONCE have we gotten a certified or registered letter from the city. There have been times we got a supposed 2nd notice when we never got the first. I am figuring this is why they are supposed to be sent either registered or certified mail.
Eh, it’s the City of Batavia Code Enforcement though, rules don’t apply to them.
